Law enforcement has spent decades developing a deep understanding of Fourth Amendment jurisprudence—but how well do we understand the implications of the First Amendment? From the first day at the academy, officers receive extensive training on clearly established Fourth Amendment standards and interpretations. But how much time is devoted to First Amendment law? Often, not much—or not enough. The First Amendment guarantees freedoms related to religion, expression, assembly, and the right to petition. This session will examine the legal implications of the First Amendment on law enforcement operations, including its application in policy development and department training requirements.
